DMCA Notification Requirements

Your notification to IT Savvy’ Designated Copyright Agent must contain the following information in writing:

(i) a physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed;

(ii) identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works on the Site are covered by a single notification, a representative list of such works on the Site;

(iii) identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit IT Savvy to locate the material;

(iv) information reasonably sufficient to permit IT Savvy to contact the complaining party, such as an address, telephone number, and, if available, an electronic mail address at which the complaining party may be contacted;

(v) a statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law (for example, “I am under the good faith belief that the use of the copyrighted content that is identified herein is not authorized by the copyright owner, its agent, or the law.”); and

(vi) a statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed (for example, “I swear, under penalty of perjury, that the information in this notification is accurate and that I am the copyright owner, or authorized to act on behalf of the copyright owner, of the copyright(s) that is/are allegedly infringed by the aforementioned content.”).

Please consult your legal counsel (or see 17 U.S.C. § 512) to confirm these requirements and your compliance therewith. It is IT Savvy’ policy to respond to notices of alleged infringement that comply with the DMCA. In addition, IT Savvy will promptly terminate without notice user accounts of members that are determined by IT Savvy to be “repeat infringers.” If IT Savvy receives more than three separate takedown notices regarding a member’s postings, then that member will be considered a repeat infringer and that member’s user account will be terminated.

Any other feedback, comments, requests for technical support or other communications should be directed to IT Savvy support through You acknowledge that if you fail to comply with all of the requirements of this section, your DMCA notice may not be valid. Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability.

If a counter notice is received by the Designated Copyright Agent, then IT Savvy may send a copy of the counter notice to the original complaining party informing that person or entity that IT Savvy may restore the removed posting or cease disabling access to it in ten business days. Unless the copyright owner files an action seeking a court order against the member submitting the posting, the removed posting may be replaced, or access to it restored, in ten to fourteen business days or more after receipt of the counter notice, at IT Savvy’ sole discretion.

DMCA Counter Notification Requirements

If you believe that your posting that was removed (or to which access was disabled) is not infringing, or that you have the authorization from the copyright owner, the copyright owner’s agent, or pursuant to law, to submit the posting to the Site, then you may send a counter notification.

A counter notification should be sent to IT Savvy’ Designated Copyright Agent at the address listed below and should contain the following information:

(i) Your physical or electronic signature

(ii) Identification of the posting that was removed or to which access has been disabled and the location at which the content appeared before it was removed or access to it was disabled;

(iii) A statement under penalty of perjury that you have a good faith belief that your posting was removed or disabled as a result of mistake or misidentification of the posting to be removed or disabled; and

(iv) Your name, address, telephone number, and e-mail address, a statement that you consent to the jurisdiction of the federal court in Faridabad, Harayna, India and a statement that you will accept service of process from the person who provided notification of the alleged infringement.
